By accessing, registering, or using the dukan26 platform (“Platform”), whether as a Client
(Merchant / Shop Owner) or Customer (End User), you acknowledge that you have read,
understood, and agreed to be bound by these Terms & Conditions.
If you do not agree with any part of these Terms, you must not use the Platform.
2. Nature of Service (Platform Role)
dukan26 is a Software as a Service (SaaS) platform.
dukan26 does not sell, purchase, deliver, store, or inspect any products.
dukan26 only provides technical tools for billing, order management, and customer interaction.
All transactions occur directly between Client and Customer.
dukan26 acts only as a technology provider and is not a party to any transaction.
3. Client (Merchant) Responsibilities
The Client is solely and fully responsible for:
Offline billing and online order billing
Product listings, pricing, stock, quality, images, and descriptions
Customer communication and order confirmation
Invoice generation, taxes (GST/VAT), and legal compliance
Order approval, rejection, or cancellation
Delivery, returns, refunds, and exchanges
Business licenses, registrations, and statutory compliance
dukan26 shall not be responsible for any Client action or omission.
4. Customer Responsibilities
Customers must provide accurate personal and order information.
Issues caused due to incorrect details shall be the sole responsibility of the Customer.
Any dispute between Client and Customer must be resolved directly between them.
dukan26 will not mediate or resolve disputes.
5. Orders & Approval
Orders placed by Customers are requests only.
Final approval or rejection lies solely with the Client.
dukan26 is not responsible for delays, rejections, or non-fulfillment.
6. Payments, Billing & Financial Risk
All payments and billing are the responsibility of the Client.
dukan26 does not verify payment accuracy.
dukan26 shall not be liable for incorrect billing, duplicate billing, payment failures, fraud, or financial losses.
7. Data, System Availability & Security
While dukan26 takes reasonable measures to maintain availability and security,
uninterrupted or error-free service is not guaranteed.
Server downtime
Internet or hosting failures
Data loss or corruption
Cyber attacks, malware, hacking
Force majeure events
Clients are advised to maintain their own data backups.
8. Account Misuse & Termination
dukan26 reserves the right to suspend or terminate accounts without notice if:
Illegal activities are detected
Fraud or misuse is suspected
Fake or prohibited products are listed
Terms & Conditions are violated
Such termination shall not entitle the user to any compensation.
9. Legal Compliance
Compliance with applicable laws and taxes is the sole responsibility of the Client.
dukan26 shall not be liable for any legal actions against Clients.
10. Limitation of Liability
To the maximum extent permitted by law, dukan26 shall not be liable for:
Direct or indirect damages
Business interruption
Loss of profits, data, or reputation
Legal claims or penalties
dukan26’s total liability shall be ZERO.
11. Indemnification
Clients and Customers agree to indemnify and hold harmless dukan26 from any claims,
damages, losses, liabilities, or legal expenses arising from their use of the Platform.
12. Modification of Terms
dukan26 may modify these Terms at any time without notice.
Continued use of the Platform constitutes acceptance of updated Terms.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
All disputes shall fall under the exclusive jurisdiction of courts in India.
14. Final Authority
dukan26’s interpretation and decision regarding these Terms shall be final and binding.
